YOUR ESTATE PLAN SHOULD INCLUDE A LIVING TRUST

The purpose of an estate plan is to identify who manages your assets upon your incapacity and death (Agent, Trustee, Executor) and who inherits your remaining assets after your death (Beneficiaries).  We recommend that estate plans include a living trust for clients who have children, own real estate or have more than $150,000 in non-IRA type assets. 
A living trust will avoid the delay and expense of probate.


WHY UPDATE YOUR LIVING TRUST

The Federal Estate Tax law has changed considerably in the last 10 years.  Therefore, a new living trust prepared for a married couple today may contain very different provisions than in the past, when estate tax exemptions were lower.  An old living trust may result in unnecessary capital gains taxes and fees when incapacity or death occurs.  We recommend that you review your living trust, Power of Attorney and Advance Health Care Directive to consider whether the choices you made reflect your wishes today.  When you amend or “Restate” your living trust, you do not need to re-title your assets.
